LootBuzz Inc. ("LootBuzz" or “LootBuzz.com”), operates commission-based affiliate marketing from our merchant partners ("Affiliate Merchants"). To certify that you, as an LootBuzz.com Registered User ("User"), fully understand what your rights are as a User, and what our responsibilities are to you, we have created this User Agreement ("Agreement"). As a User of the LootBuzz.com website (referred to herein as "LootBuzz.com" or “LootBuzz” or the "Site"), you confirm that you have read, understood and agreed to the following "Terms and Conditions," and give permission to be bound by all of the "Terms and Conditions," including any future amendments or updates thereto.
User Account
Eligibility
You must be an individual, 18 years of age or older.
You may maintain only one account; any duplicate accounts will be subject to cancellation.
You must have an email address to be able to create an account and receive the privileges of membership.
You also agree not to 'spam' unknown individuals by sending them unwanted emails or solicit membership.
Registered Users must be human: no machines, scripts, or automated services may be used.
Account Access and Password
Upon registration, you will choose a password that will allow you to access your LootBuzz profile and account.
You must be logged into LootBuzz and enter your password to change your account settings and payment preferences.
You are accountable for keeping your email address, password, account numbers, and other account information confidential.
LootBuzz is not responsible for any credits or debits made to your account by someone else who uses your password.
LootBuzz is permitted to act on instructions received under your password.
By registering with LootBuzz you are granting LootBuzz, without expectation of remuneration, a perpetual, world-wide, royalty-free license to distribute, copy, adapt for use, reproduce, transmit and otherwise utilize all content and information you post on this web site for any reason and in any media now known or hereinafter developed.
Content Submission
Posting a Deal
Any deal posted on the site articulates only the view of the author of the deal and does not necessarily reflect the views of LootBuzz or any person or entity associated with it. While LootBuzz may use moderators and administrators to monitor the content and appearance of deals posted at the Site, you acknowledge that LootBuzz is under no obligation to do so. Considering the real-time nature of internet, it is impossible for us to monitor or review every deal. You agree that neither LootBuzz, nor any person or entity associated with it, will be held responsible for the contents, accuracy, completeness or validity of any information posted on the Site.
You agree that you will not use the web site to post any material, or links to any material, which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise in violation of any law. You agree you will not post promotional information for a web site, entity or entity with which you are an affiliate, employee, owner, or otherwise receive any benefit from. You agree you will not post any copyrighted material without the permission of the copyright holder, unless such copyright is owned by you.
The following are inappropriate for posting on LootBuzz web site and will be considered a violation of these Terms, subjecting the user who posts them to immediate suspension or termination: Advertisements, referral Programs, chain letters, pyramid or ponzi schemes, solicitations and links to on-line gambling sites. LootBuzz reserves the right to delete any deal for any reason whatsoever, at our sole discretion. You agree that you are solely responsible for the content of the deal you post, and that you will indemnify and hold harmless LootBuzz and their agents, employees and representatives with respect to any claim based upon the content, appearance and/or transmission of your deal(s). Use of Online Coupons
As an additional FREE value-added service to its users, LootBuzz provides online coupons. LootBuzz is not responsible for the redemption, errors/omissions or expiration of online coupons and it is your responsibility to make sure that discounts, special pricing or free offers are present in the checkout process of an Affiliate or Participating Merchant. LootBuzz has no control over the legality of any coupons or other offers made by Affiliate or Participating Merchants. Since all coupons are provided by the Affiliate or Participating Merchant, LootBuzz has no control over whether such Merchants will honor the coupons shown on LootBuzz.com.
In the event you have a dispute with an Affiliate or Participating Merchant, you agree to contact them directly and further, waive and release LootBuzz from any and all claims, demands, actions, damages (actual and consequential), losses, costs or expenses of every kind and nature, known and unknown, disclosed and undisclosed, relating to that dispute.
Delivery of Products/Services
All products/services purchased will be delivered to the user via the Affiliate or Participating Merchant, once the transaction has been completed. LootBuzz is, in no way, responsible for the delivery of products/services purchased from an Affiliate or Participating Merchant. Each Affiliate or Participating Merchant has its own set of rules and requirements for delivery of the products/services purchased. LootBuzz is not responsible for the quality of the products/services purchased on its web site. Any warranties offered are provided solely by the Affiliate or Participating Merchant or manufacturer.

SOME STATES DO NOT ALLOW LIMITATIONS ON INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. PLEASE CHECK THE STATUTES IN YOUR STATE.
YOU AGREE TO INDEMNIFY AND HOLD LootBuzz, ITS PARENTS, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, PARENTS, SUBSIDIARIES, AGENTS AND REPRESENTATIVES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEY'S FEES AND EXPENSES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR USE OF LootBuzz WEB SITE, THE VIOLATION OF THESE TERMS AND CONDITIONS BY YOU, OR THE INFRINGEMENT BY YOU, OR ANY OTHER USER OF YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY, OR AS A RESULT OF ANY THREATENING, LIBELOUS, OBSCENE, HARASSING OR OFFENSIVE MATERIAL CONTAINED IN ANY MEMBER COMMUNICATIONS.
Compliance with Laws and Regulations
You agree to comply with all applicable laws, rules and regulations. You may participate in LootBuzz.com if and to the extent that such participation is permitted by such laws, rules and regulations. LootBuzz may refuse to enroll, restrict, modify or terminate your username, password and registration without liability to you or any other third party if you violate any law, rule or regulation, of if your participation could violate any law, rule or regulation
Proprietary Rights to Content
You acknowledge that LootBuzz.com content, including but not limited to: text, sounds, photographs, graphics, or other material contained in any LootBuzz.com communication, advertisements or messages, whether by LootBuzz, LootBuzz.com or LootBuzz's advertisers or Affiliated Merchants, service and software are protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws. You are only permitted to use content, service, or software as expressly authorized by LootBuzz, its advertisers and Affiliated Merchants, as the case may be.
Termination of Agreement
Any violation of the Terms and Conditions of this Agreement is grounds for termination of your user name, password and registration with LootBuzz.com. LootBuzz reserves the right to terminate your user name, password and registration, if your account is inactive for twelve (12) consecutive months. You may terminate your user name, password and registration at any time by sending an email to service@lootbuzz.com.
Disclosure of Account Information
You authorize LootBuzz to only disclose to third parties information you have provided, or information that LootBuzz has obtained about your LootBuzz account or shopping behavior: (i) to agents and licensors of LootBuzz or its affiliates, such as independent auditors, consultants or attorneys; (ii) to comply with government agency or court orders or requests; (iii) in providing aggregated and non-personalized marketing services for an advertising or store partner. Further, you authorize LootBuzz to receive any account information from any Affiliated Store including, but not limited to information regarding purchases made, items searched for or added to your shopping cart, products ordered, order number, the time and date the purchase occurred, and the email address entered for the purchase. You agree to hold the Affiliated Store harmless for any information disclosed to LootBuzz. You allow LootBuzz to collect and use non- personalized marketing information regarding visits and related to purchases made from internet commerce sites.
By signing up for membership at LootBuzz, you agree to receive communications that are account and membership related (e.g., that we've added money to your account, that we are mailing you a check on a certain date) as well as periodic shopping-related emails that highlight coupons & special deals that are available to LootBuzz members. You can opt-out of receiving emails that are not account-related by either (i) visiting your account page and clicking on the Profile link, or (ii) following the unsubscribe link on any of the emails. Since we need to communicate account information with you in order to operate our service, you cannot unsubscribe from account information emails. But rest assured that we don't send account emails unnecessarily.
Termination or Changes to the Program
LootBuzz reserves the right to terminate the Program at any time with notice. Notification of Program termination will be sent to the email address you provide to LootBuzz during the registration process. LootBuzz will not be responsible for failing to notify you of Program termination where such failure is caused by any reason outside the control of LootBuzz, including an error in your email Program, an inaccurate email address, your failure to check for your email online, or your failure to inform LootBuzz of a change in your email address.
The agreement can be modified by LootBuzz from time to time, with or without notice, and your continued participation in the Program after such modification shall be deemed to be your acceptance of any such modification. It is your responsibility to check the Terms & Conditions page of the LootBuzz Web site regularly to determine any agreement modifications. You must immediately cease participation in the Program, if you do not agree to any modification of this Agreement.
Notice
All LootBuzz notices will be given by email, postal mail, or by general posting to the LootBuzz.com website.
Waiver
LootBuzz’s failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
Choice of Law
The Terms and Conditions of Use stated herein shall be governed by and construed in accordance with the laws of the State of

If your account has been associated with any legally questionable activity, LootBuzz reserves the right to terminate your user name, password and registration,
Severability of Provisions
Any provision (or part thereof) of this Agreement which is found to be invalid, prohibited, or unenforceable, shall be ineffective only to the extent of such prohibition and unenforceable, without invalidating the remainder of the provision or the remaining provisions hereof. To the extent permitted by the applicable law, each of the parties hereto hereby waives any provision of law which prohibits or renders unenforceable any provisions hereof in any respect.
